1. The agreement
These terms govern use of https://aetherfunded.com and the Aether Funded evaluation program (“Services”). By creating an account, buying a Test, or using the Control Center, you agree to them. If you do not agree, do not use the Services.
Aether Funded (“Aether,” “we,” “us”) is an evaluation desk operated from Canada. The Services are a paid, simulated futures evaluation. We do not hold or manage client trading capital, we do not accept deposits to be traded in live markets, and we do not route orders to an exchange on your behalf. Fees you pay are for access to the evaluation, not a brokerage deposit.
We are not a dealer, adviser, futures commission merchant, introducing broker, or exchange. Nothing on the site is an offer of securities, a solicitation to trade futures for a customer account, or investment, tax, or legal advice. If we ever enable live market access for an account, we will say so in writing first. That would be a different service.
2. Eligibility
You must be at least 18 years old and able to form a contract. You are responsible for whether evaluation trading is lawful where you live. We may refuse, suspend, or close an account at our discretion, including where we cannot reasonably serve a jurisdiction.
3. The Test and Funded phases
A Test is a paid, simulated evaluation. Passing requires the published rules on the rules page: a 6% profit target, end-of-day trailing drawdown, 50% consistency (which raises the remaining target rather than failing the account), at least five trading days, and a flat book at the futures session close.
A passed Test may be activated as Funded. Funded is still a simulated evaluation account on the same desk. It is not live buying power and not a customer brokerage account. Funded accounts fail on drawdown and on positions left open at the close. Consistency and the profit target do not fail a Funded account.
4. Simulation, platforms, and data
Fills, prices, and balances in the Control Center are simulated. They may differ from live exchange markets, including during news, thin liquidity, or halt conditions. We may change how simulation is recorded as we add broker connections.
Tradovate, NinjaTrader, TradingView, and similar names are third-party platforms. Listing them as planned connections is not a partnership, endorsement, or a promise of access on a date. You will not receive third-party logins until we can provision them.
5. Fees and payments
Test fees are one-time charges for that evaluation, billed by Stripe. A paid reset is a separate one-time charge at 60% of that size’s published Test fee. It restarts an eligible account as an Active Test and clears its journal. Resets are available on failed Tests, failed Funded accounts, and Active Tests. A passed Test must be activated as Funded rather than reset. Unless required by law or we agree in writing, Test and reset fees are non-refundable once applied. Chargebacks or payment disputes may result in immediate closure of related accounts. Promo codes do not apply to resets.
6. Payouts
Payouts are available only on Funded accounts that have not failed. Available balance is 90% of profit earned after Funded activation (Test profit is not payable), minus approved and pending requests. The first request requires five winning funded days — a calendar day with at least one closed trade and a positive closed P/L. Later requests may be made 14 days after the last approved review or the last pending request. Only one request may sit pending at a time. You must verify the email on the account, pass a desk identity review, and have a payout destination on file before a request is accepted. Every request is reviewed by the desk. Approval is not automatic. We may deny a request for rule breaches, inconsistent activity, identity or payment issues, or suspected abuse.
A payout is a discretionary performance payment from the desk, paid from firm funds, tied to a simulated evaluation. It is not a withdrawal of money you deposited, not exchange-cleared capital, and not a brokerage cash balance. We never hold your trading funds. Before the first payout the desk verifies your identity from the legal name and country you submit, and may ask for a government photo ID by email. Approved amounts are sent to the Wise, PayPal, bank, or other destination you save in the Control Center. Timing depends on review and the payment rail.
7. Conduct
You will not share accounts, manipulate fills, exploit delays or bugs, use the site to launder funds, or abuse promotions. We may flatten, lock, or fail accounts that we reasonably believe violate these terms or the published rules.
8. Intellectual property
The site, Control Center, rules engine, and Aether marks are ours. You may not copy the product, scrape the service, or present Aether as your own firm.
9. Disclaimers and liability
The Services are provided “as is.” Simulated results are not a guarantee of live results, funding, or payouts. To the fullest extent allowed by law, Aether is not liable for lost profits, lost data, or indirect damages. Our total liability for a claim is limited to the Test fees you paid us in the 90 days before the claim.
10. Governing law
These terms are governed by the laws of Canada, without regard to conflict-of-law rules. Courts in Canada have exclusive jurisdiction, except where applicable consumer law gives you a right to sue where you live.
11. Changes and contact
We may update these terms. The date at the top is the effective date. Continued use after a change is acceptance of the new terms. Questions: support@aetherfunded.com.
